Tertiary sector decree: AFNOR Energies can support you

Now that the new tertiary sector decree has been published, it’s time to get up to speed with its requirements: reduce your final energy consumption by 40% in 2030, 50% in 2040 and 60% in 2050 compared with 2010. The ELAN Act and its implementing decree set out the energy-saving targets that two landmark laws – the Grenelle II Act of 2010 and the Energy Transition Act of 2015 – imposed on tertiary buildings.

In concrete terms, decree no. 2019-771 of July 23, 2019, published in the Journal Officiel of July 25, 2019 in application of article 175 of the law of November 23, 2018, assigns these targets to the entire existing tertiary stock as of October 1, 2019, and to each building over 1,000 m² taken individually within this stock. It provides for a second option: to meet, by these deadlines, a level of final energy consumption set in absolute terms, by decree, according to the energy consumption of new buildings in their category.

These measures will help to enhance the value of energy-efficient real estate assets, and those that are already in the process of becoming so. The text stipulates that the assessment of compliance with the obligation must be appended to sales and rental documents. Finally, the text organizes data: it provides for the deployment of an IT platform to collect consumption data. From 2021 onwards, owners (or their delegates) will have to fill in the form every year, by September 30 at the latest, with data from the previous year, through an operator to be designated by the State.
